IMPORTANT NOTICE: THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER WHICH AFFECT YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY BEFORE USING THIS SITE OR MAKING A PURCHASE.

Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Eraworth (“Eraworth,” “we,” “us,” or “our”) governing your access to and use of this website and any related websites, checkout pages, landing pages, advertisements, emails, customer support interactions, packaging inserts, digital content, educational charts, timelines, posters, and other products and services offered by or on behalf of Eraworth (collectively, the “Service”).

By accessing, browsing, purchasing from, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must immediately discontinue use of the Service.

Changes to Terms

Eraworth reserves the right to modify, amend, supplement, or replace these Terms at any time in its sole discretion.

Changes are effective upon posting unless otherwise required by applicable law. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

Eligibility

The Service is intended solely for individuals who are at least eighteen (18) years of age, or the age of majority in their jurisdiction, and legally capable of entering into a binding contract.

By using the Service, you represent and warrant that you meet these requirements.

Product Information and Usage Disclaimer

All information, content, statements, recommendations, and materials provided through the Service regarding history, timelines, educational charts, posters, learning materials, and product usage are for general informational and educational purposes only.

Eraworth does not provide professional academic, historical, educational, legal, or other specialized advice.

Eraworth products are intended for their designated uses as described in the applicable product descriptions and instructions.

Customers should carefully review product descriptions, dimensions, materials, display instructions, care guidelines, and other information before purchasing or using a product.

Historical timelines, charts, and educational materials may simplify complex events, reflect particular interpretations, or contain errors or omissions. Customers are responsible for determining whether a product is appropriate for their intended use.

International Sales and Compliance

Eraworth products may be offered for sale in multiple jurisdictions.

Customers are responsible for ensuring that products purchased from Eraworth may lawfully be purchased, imported, possessed, and used within their jurisdiction.

International customers may also be responsible for customs duties, taxes, import fees, or other charges imposed by local authorities.

Eraworth does not guarantee that every product, label, material, packaging format, or product claim complies with the laws of every jurisdiction in which the website may be accessed.

No Guarantee of Results

Individual experiences with educational products may vary depending on a customer’s interests, age, prior knowledge, learning preferences, intended use, and other factors.

Eraworth makes no representation, warranty, or guarantee regarding specific educational outcomes, learning results, or other results from the use of its products, except as expressly stated or required by applicable law.

Testimonials, reviews, customer experiences, advertising statements, and references to potential product benefits are not guarantees that you will experience the same or similar results.

The absence of a particular expected result does not, by itself, constitute a defect, product failure, or misrepresentation.

Assumption of Risk

By purchasing and using Eraworth products, you acknowledge that educational materials may present information in a condensed or simplified format and may not address every interpretation, perspective, or detail.

You are responsible for determining whether a product is appropriate for your intended use and for reviewing its product description and any instructions or information provided with it.

To the extent permitted by applicable law, you assume the risks associated with using a product for a purpose other than its designated use or contrary to its instructions.

Nothing in this section excludes liability or limits consumer rights that cannot legally be excluded or limited.

Product Materials and Manufacturing

Eraworth products may be manufactured, packaged, tested, stored, or fulfilled by third-party manufacturers and service providers.

Product labels, material information, specifications, dimensions, and other product information are intended to be accurate at the time of manufacture and sale.

Products may exhibit reasonable variations in color, texture, appearance, packaging, materials, printing, or other non-essential characteristics between individual products or production batches.

Such reasonable variations do not necessarily constitute a defect or misrepresentation.

Eraworth reserves the right to update product designs, materials, packaging, sourcing, suppliers, specifications, or other product characteristics where permitted by law.

Third-Party References and No Affiliation

Any references to third-party research studies, academic institutions, publications, journals, researchers, historical sources, museums, governmental agencies, educators, historians, publishers, laboratories, certifications, manufacturers, or other third parties are provided for informational purposes only unless expressly stated otherwise.

Such references do not necessarily constitute an endorsement, sponsorship, partnership, or affiliation.

Eraworth is not affiliated with a third party merely because that third party is referenced on our website, packaging, advertising, or other materials.

User Content and Testimonials

Testimonials, ratings, reviews, photographs, videos, comments, and other customer-submitted content represent the experiences or opinions of the individuals providing them and are not guarantees of similar results.

By voluntarily submitting content to Eraworth, including reviews, photographs, videos, comments, or testimonials, you grant Eraworth a non-exclusive, worldwide, royalty-free license to use, reproduce, display, publish, distribute, adapt, and otherwise use that content for lawful business and marketing purposes, subject to applicable law.

You represent that you have the rights necessary to submit such content and that your submission does not violate the rights of any third party.

Intellectual Property

Unless otherwise stated, all website content, branding, product names, graphics, photographs, product designs, written materials, educational content, advertisements, logos, page layouts, videos, and other materials associated with the Service are owned by or licensed to Eraworth.

Such materials are protected by applicable intellectual property laws.

You may not copy, reproduce, republish, distribute, modify, create derivative works from, commercially exploit, or otherwise use any protected portion of the Service without prior written authorization from Eraworth, except where permitted by law.

Goods Not for Resale

Unless Eraworth expressly authorizes otherwise in writing, products purchased through the Service are intended for personal or household use.

You may not purchase products for unauthorized commercial resale, redistribution, or export.

Eraworth reserves the right to limit quantities, reject transactions, or cancel orders where we reasonably believe products are being purchased for unauthorized resale or other improper purposes.

Orders and Pricing

All orders are subject to acceptance and availability.

Eraworth reserves the right, to the extent permitted by law, to:

• reject or cancel an order;

• limit quantities;

• correct pricing, product-description, or typographical errors;

• discontinue products;

• change prices or promotions; and

• refuse service where reasonably necessary.

If an order is cancelled after payment has been collected, the applicable amount will be refunded in accordance with our payment processor’s procedures and applicable law.

Prices, promotions, and product availability may change without notice.

Taxes, shipping charges, customs charges, and other applicable fees may be added at checkout where required.

Shipping and Delivery

Estimated shipping and delivery times are provided for convenience and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by carriers, customs processing, weather, natural disasters, high-volume periods, address errors, supply-chain disruptions, or other circumstances outside our reasonable control.

Customers are responsible for providing complete and accurate shipping information.

Additional shipping-related terms may be described in our Shipping Policy, which is incorporated into these Terms by reference.

Refunds and Returns

Refunds, replacements, and any applicable product guarantee are governed by Eraworth’s Refund & Replacement Policy, which is incorporated into these Terms by reference.

Eligibility requirements, deadlines, exclusions, required documentation, and other conditions described in that policy apply to all refund and replacement requests.

Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable consumer-protection law.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

ERAWORTH DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

Some jurisdictions do not permit certain warranty exclusions, so some of the foregoing exclusions may not apply to you.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ERAWORTH AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR PRODUCTS.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ERAWORTH ARISING FROM OR RELATING TO A CLAIM SHALL NOT EXCEED THE GREATER OF:

• The amount you paid to Eraworth in connection with the transaction giving rise to the claim; or

• One hundred U.S. dollars (US $100).

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Eraworth and its owners, directors, officers, employees, contractors, agents, affiliates, and service providers from claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys’ fees, arising from:

• your misuse of the Service or products;

• your violation of these Terms;

• your violation of applicable law; or

• your infringement of the rights of another person or entity.

Force Majeure

Eraworth will not be responsible for failures or delays in performance resulting from events outside its reasonable control, including natural disasters, severe weather, pandemics, epidemics, labor disruptions, supply-chain interruptions, transportation delays, carrier delays, power failures, telecommunications outages, governmental actions, war, civil unrest, or similar events.

Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR PARTICIPATE IN A CLASS ACTION.

To the extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms, the Service, an Eraworth product, or a transaction with Eraworth shall be resolved through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) in accordance with its applicable Consumer Arbitration Rules.

The arbitration will be governed by the Federal Arbitration Act.

Arbitration shall be conducted on an individual basis only.

Neither you nor Eraworth may bring or participate in a class action, collective action, consolidated proceeding, or representative action to the extent such waiver is enforceable under applicable law.

You and Eraworth each waive the right to a jury trial for disputes subject to arbitration.

You may opt out of this arbitration agreement by sending written notice within thirty (30) days of your first purchase.

Your notice should include your full name, the product purchased, the email address associated with the purchase, and a clear statement that you wish to opt out of the arbitration agreement.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict-of-law principles, except where federal law applies or where applicable consumer law requires otherwise.
